Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Aqlyx platform, including the onboarding portal at onboard.aqlyx.com and the analytics dashboard at dashboard.aqlyx.com (collectively, the "Service"), operated by Aqlyx ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. The Service
Aqlyx is an AI-powered business intelligence platform that connects to your business data sources (such as Shopify, Google Ads, Meta Ads, and GA4) and enables you to query and analyse that data using natural language. The Service is provided on a subscription basis.
2. Account Registration
To use the Service you must register an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@aqlyx.com if you suspect any unauthorised use of your account.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your organisation.
3. Free Trial
New accounts receive a 14-day free trial. Your payment details are collected at signup via Stripe and stored securely by Stripe; we do not store card numbers. Your card will not be charged until the trial period ends. You may cancel at any time during the trial without charge.
4. Subscription and Payment
After the trial, the Service is billed monthly in advance. Prices are displayed at the time of signup and on your dashboard. We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
All fees are non-refundable except where required by applicable law. If a payment fails, we will attempt to notify you and may suspend access to the Service until payment is resolved.
5. Your Data
You retain ownership of all data you connect to or import into the Service ("Customer Data"). By connecting a data source, you grant us a limited licence to access, process, and display that data solely to provide the Service to you.
We do not sell your Customer Data to third parties. We do not use your Customer Data to train AI models. We act as a data processor on your behalf; your use of connected platforms (Shopify, Google, Meta, etc.) is governed by those platforms' own terms.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation
- Attempt to gain unauthorised access to any part of the Service or its underlying systems
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Resell or sublicence access to the Service without our written consent
- Use the Service in a way that could damage, disable, or impair its availability to other users
- Submit false or misleading information during registration or use
7. Intellectual Property
The Service, including all software, algorithms, designs, and content produced by Aqlyx (excluding Customer Data), is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features.
8. AI-Generated Content
The Service uses large language models to generate analytical responses and recommendations. AI-generated content is provided for informational purposes only. It may contain errors or inaccuracies. You are solely responsible for any business decisions made based on output from the Service. We expressly disclaim liability for decisions made in reliance on AI-generated content.
9. Availability and Support
We aim to maintain high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated where reasonably possible. Support is provided via email at support@aqlyx.com.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Aqlyx and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising out of your use of or inability to use the Service.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to Aqlyx in the 12 months preceding the claim.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. Termination
You may cancel your subscription at any time from your dashboard or by emailing support@aqlyx.com. Access continues until the end of the current billing period. We reserve the right to suspend or terminate your account immediately if you breach these Terms.
Upon termination, your Customer Data will be retained for 30 days and then permanently deleted, unless we are required by law to retain it longer.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or via a notice in the Service. Continued use of the Service after the effective date of updated Terms constitutes your acceptance.
14. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in the applicable jurisdiction.
